These General Terms and Conditions of Sale ("GTC") govern sales concluded on the website www.wildust.com between:

WILDUST EURL, with a share capital of €1,346, whose registered office is located at 12C chemin de la Devèse, 33360 Carignan-de-Bordeaux, registered with the Bordeaux Trade and Companies Register under number 841 890 999 R.C.S. Bordeaux, hereinafter referred to as "WILDUST" or "the Seller",

and any natural person acting for purposes not falling within the scope of their commercial, industrial, craft, liberal, or agricultural activity and making a purchase on the site, hereinafter referred to as "the Customer".

Article 1 — Purpose and Scope

These GTC define the rights and obligations of WILDUST and the Customer in connection with the online sale of products offered on www.wildust.com.

Validation of an order implies full and unreserved acceptance of the GTC in force at the time of the order. WILDUST may modify these GTC at any time; the applicable GTC are those accepted by the Customer when validating their order.

Article 2 — Products

The products offered for sale are those presented on the Site, within the limits of available stock. The essential characteristics of each product are indicated on its product sheet.

WILDUST takes the utmost care in presenting the products. Slight differences in color or rendering may nevertheless result from screen settings, lighting, or manufacturing processes, and do not necessarily constitute a defect of conformity.

In case of unavailability of a product after order validation, the Customer will be informed as soon as possible and the sums corresponding to the unavailable product will be refunded.

2.1 Sizes, cut, and fit

The size guides, measurements, and cut indications provided on the Site serve as an aid to choice. The appearance and fit of a garment may vary depending on body type, wearing preferences, and product characteristics.

A difference in fit due to body type or size choice does not, by itself, constitute a lack of conformity. This provision does not limit the Customer's rights when a product actually has a defect of conformity within the meaning of the law.

Photographs are non-contractual. Slight variations in color, rendering, or style may exist between the visuals presented and the actual product.

Article 3 — Price

Prices are indicated in the currency displayed on the Site and include applicable taxes when they are due and collected by WILDUST. The total price of the order, including any delivery costs and taxes collected at the time of purchase, is indicated to the Customer before final order validation.

WILDUST reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation, subject to an obvious pricing error.

Article 4 — Order

The Customer selects the products they wish to purchase and verifies, before validation, the contents of their cart as well as the information necessary for processing and delivering their order.

Before confirming the order, the Customer can correct any input errors. Final validation of the order implies an obligation to pay.

An order confirmation is sent by email to the address provided by the Customer. The Customer is responsible for the accuracy of the information provided, particularly their email address and delivery address.

WILDUST reserves the right to refuse or cancel an order for a legitimate reason, particularly in cases of fraud or attempted fraud, payment incident, obviously erroneous information, or an unresolved prior dispute.

Electronic records relating to orders, payments, exchanges with the Customer, and operations carried out on the Site may be kept and produced as evidence, under the conditions provided by applicable regulations.

When objective elements reasonably suggest fraud, identity theft, abusive use of a payment method, or an anomaly affecting the order, WILDUST may temporarily suspend its processing and request strictly necessary information or supporting documents from the Customer for verification. In the absence of a sufficient response or if a confirmed fraud risk exists, WILDUST may refuse or cancel the order within the limits permitted by law.

Article 5 — Payment

Payment is due at the time of the order. The Customer can use the payment methods offered on the Site during checkout.

Transactions are processed by secure payment providers. WILDUST does not have access to the Customer's full bank details.

The order is not considered definitively validated until payment has been authorized by the relevant provider.

5.1 Promotional offers and discount codes

Unless otherwise stated, promotional offers and discount codes are valid for the duration, on the products, and under the conditions indicated at the time of their presentation. They are not cumulative unless expressly stated.

In the event of an obvious technical error affecting a promotion, discount code, currency conversion, or displayed price, WILDUST may correct the error before shipment and, where necessary, offer the Customer to confirm the order at the correct price or proceed with its cancellation and refund.

In the event of clearly fraudulent use, misuse, or use contrary to the conditions of an offer, WILDUST may refuse the promotional benefit concerned or cancel the order within the limits permitted by law.

Article 6 — Delivery

Orders are shipped to the delivery address indicated by the Customer. The carriers, estimated costs, and delivery times available are indicated at the time of the order.

WILDUST strives to ship orders within the deadlines announced on the Site. Unless otherwise agreed with the Customer, delivery will take place no later than thirty days following the conclusion of the contract.

In case of error or incomplete address communicated by the Customer, any costs generated by a new shipment may be charged to them.

6.1 Transfer of risks

When the carrier is proposed by WILDUST, the risk of loss or damage to the product is transferred to the Customer when the Customer, or a third party designated by them, takes physical possession of the package.

When the Customer chooses a carrier other than those offered by WILDUST, the transfer of risks occurs upon delivery of the goods to this carrier, in accordance with applicable legal provisions.

6.2 Damaged package or delivery incident

The Customer is invited to check the condition of the package upon receipt and to promptly report any anomaly, missing product, or damage observed to WILDUST, with any useful information allowing the claim to be processed.

This recommendation does not deprive the Customer of their rights under statutory guarantees.

Article 7 — International Orders, Customs Duties and Taxes

Orders shipped to a destination subject to import formalities (outside the EU) may be subject to customs duties, import taxes, customs clearance fees or other local charges applied by the destination country.

These charges are not included in the price of the products or in the delivery costs invoiced by WILDUST and remain the responsibility of the end Customer.

As the amount and terms of collection of these charges are determined by the authorities of the destination country and/or by the carrier, WILDUST is not able to calculate or guarantee them in advance.

The Customer is responsible for their payment to allow delivery of their order.

Refusal to pay duties, taxes or import charges, refusal of the package or its non-collection does not, by itself, constitute the exercise of the right of withdrawal.

When the package is returned to WILDUST following a refusal, non-collection or non-payment of import charges, the costs actually incurred by WILDUST due to this return - in particular return transport, duties, taxes or administrative fees for "re-importation" - will be deducted from any refundable sums to the Customer.

Article 8 — Right of Withdrawal

In accordance with article L.221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision.

When several products from the same order are delivered separately, the period runs from the receipt of the last product.

To facilitate the processing of returns and exchanges, WILDUST provides the Customer with an online procedure accessible from their customer account. The Customer selects the order and the item(s) concerned and then submits their request. After validating the request, they receive the information and documents necessary for the return as well as the procedure to follow.

The customer can also signal their return via the procedure mentioned in the Exchanges and Returns section of the website.

This online procedure allows the Customer to notify their decision to withdraw. However, it does not deprive the Customer of the possibility of exercising their right of withdrawal by any other clear and unambiguous declaration expressing their wish to withdraw, under the conditions provided by law.

Simple refusal of delivery or non-collection of the package is not sufficient, by itself, to characterize the exercise of the right of withdrawal.

8.1 Return of products

After notifying their withdrawal, the Customer has fourteen (14) days to return the products.

Products must be returned complete, unworn, with their accessories and labels, and in their original packaging. The Customer may handle and try on the product only to the extent necessary to establish its nature, characteristics, and proper functioning, as they would reasonably do in a store. Actual use of the product, washing, stains, odors, damage, or any handling preventing the product from being restocked will result in the cancellation of the refund or a depreciation of the refunded value, within the limits provided by law.

Unless otherwise indicated by WILDUST, direct return costs are borne by the Customer. All returns must be made with a tracking number and proof of shipment retained by the Customer. As long as the package has not been received by WILDUST and certified as "compliant", WILDUST cannot be held responsible for processing the refund.

8.2 Returns from abroad

The direct costs of return from abroad are borne by the Customer, unless otherwise provided by law or an error attributable to WILDUST.

The Customer must organize their return in such a way that no import duties, taxes, customs clearance fees, or administrative fees are charged to WILDUST upon re-importation of the product. When such fees are nevertheless invoiced to WILDUST, they will be deducted from the sums refundable to the Customer.

This provision does not limit the Customer's legal rights, including their right of withdrawal when applicable and legal guarantees.

8.3 Refund

In the event of a valid withdrawal, WILDUST will refund the amounts due in accordance with applicable regulations, using the same payment method as that used during the order, unless the Customer expressly agrees to another method.

WILDUST may defer the refund until the products have been recovered and their conformity verified.

Additional costs resulting from the Customer's choice of a more expensive delivery method than the standard delivery method offered will not be reimbursed.

Article 9 — Legal Guarantees

Article 10 — Use of Protective Equipment

Certain WILDUST products are designed and marketed as personal protective equipment or protective clothing and may be subject to certification, approval or a level of protection indicated on their product sheet, marking or instructions.

The Customer must use the product in accordance with its intended purpose, choose an appropriate size and fit, and comply with the instructions for use, maintenance, storage and, if applicable, replacement of the protections supplied with the product.

No protective equipment can completely eliminate the risk of injury in the event of a fall, impact or accident. The certification or level of protection indicated corresponds to the requirements and test methods applicable to the product concerned and does not constitute a guarantee of absence of injury.

These provisions are neither intended nor have the effect of excluding or limiting legal guarantees or WILDUST's liability when they are mandatorily applicable.

Article 11 — Liability

WILDUST is responsible for the proper execution of its obligations under the conditions provided by law.

However, WILDUST cannot be held responsible for damage resulting from improper use of the product, non-compliance with usage or maintenance instructions, or an external event having the characteristics of force majeure.

No stipulation of these GTC shall have the effect of excluding or limiting a right or guarantee that the Customer mandatorily benefits from by virtue of the law.

WILDUST cannot be held responsible for a delay or non-performance resulting from a force majeure event within the meaning of article 1218 of the Civil Code, for the duration and to the extent that this event prevents the execution of its obligations.

Article 12 — Intellectual Property

The elements present on the Site, including texts, photographs, illustrations, graphics, logos, videos, creations, and brand elements, are protected by applicable intellectual property rights.

Any reproduction, representation, adaptation, or exploitation, in whole or in part, without prior authorization from WILDUST or the holder of the rights concerned is prohibited, except as provided by law.

Article 13 — Personal Data

WILDUST processes personal data necessary for managing orders, payments, deliveries, returns, guarantees, customer relations, and accounting and legal obligations.

Depending on the processing concerned, their legal basis may include the performance of the contract, compliance with a legal obligation, WILDUST's legitimate interest, or the Customer's consent.

Data is accessible to authorized persons within WILDUST as well as to service providers necessary for the execution of the order, including payment providers, e-commerce platform, logistics providers, and carriers, within the limits of their missions.

Data is retained for the durations necessary for the purposes for which it is processed and for applicable legal obligations.

The Customer has, under the conditions provided by regulations, rights of access, rectification, erasure, opposition, limitation, and, where applicable, portability of their data. They can exercise their rights by writing to contact@wildust.com. They can also lodge a complaint with the CNIL.

Article 14 — Consumer Mediation

In accordance with the provisions of the Consumer Code concerning "the consumer dispute mediation process", after having contacted us and in the absence of a satisfactory response, you have the option of resorting free of charge to a consumer mediation procedure with:

Article 15 — Applicable law and disputes

These GTCs are governed by French law.

When the Customer resides in another country, this choice cannot have the effect of depriving them of the mandatory protective provisions that would be applicable to them under the law of their country of residence.

In the absence of an amicable resolution or mediation, any dispute will be brought before the competent court in accordance with the applicable legal rules.
