Terms and conditions of sale

The present conditions of sale are concluded :

- on the one hand, by WILDUST EURL, with a share capital of €1,346, whose registered office is located at 12C chemin de la devèse, in CARIGNAN DE BORDEAUX, registered in the Bordeaux Trade and Companies Register under number 841 890 999 R.C.S. BORDEAUX, hereinafter referred to as WILDUST and managing the website www.wildust.com and,

- on the other hand, by any non-trading individual wishing to make a purchase via the www.wildust.com website, hereinafter referred to as "the buyer".

Article 1. Purpose

The present conditions of sale aim to define the contractual relations between WILDUST and the purchaser, and the conditions applicable to any purchase made via the website www.wildust.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the site www.wildust.com is not directly related to his professional activity and is limited to strictly personal use, and on the other hand to have full legal capacity, allowing him to commit himself under these general conditions of sale.

WILDUST reserves the right to modify these terms and conditions of sale at any time, without prior notice.

Article 2. Products

The products offered are those listed on the site www.wildust.com company WILDUST, within the limits of available stocks. The company WILDUST reserves the right to modify at any time the assortment of products. Each product is presented on the website in the form of a description of its main technical characteristics (material, color, size). However, an error in the updating of this information may occur, and WILDUST cannot be held responsible for the cancellation of an order for a product due to the exhaustion of stocks, or for any anomalies in product descriptions. The photographs are not contractual, they are the most faithful possible but do not engage the Seller. The sale of products presented on the www.wildust.com website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices shown on the product sheets of the internet catalog are in Euros (€), inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

The site offers the possibility of displaying product prices in pounds sterling and dollars; the price corresponds to a conversion of the price in euros into the chosen currency. The rate used for this calculation is established by WILDUST on the basis of the current rate.

Products are supplied at the price valid at the time the order is placed. If a technical problem should suspend the order, so that the price displayed has not been respected, the buyer's order will be put on hold until the problem is resolved. Payment must be made in cash when the order is placed, by VISA, MASTERCARD or PAYPAL.

WILDUST reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the purchaser. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, shipping is free for orders of 200 euros or more (incl. VAT); for orders of less than 100 euros (incl. VAT), a contribution to shipping costs will be charged.

Article 4. Order and payment terms

Before ordering, the buyer must create an account on the site WILDUST. The account creation section can be accessed directly from the top menu of the site. At each visit, the buyer, if he wishes to order or consult his account (order status, profile...), will have to identify himself using this information. WILDUST offers the buyer the option of ordering and paying for its products in several stages, with 2 payment options to choose from:

- Payment by credit card: the buyer selects the products he/she wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Payment by credit card". In the next step, the buyer is asked to check all the information provided, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the bank's secure interface (CITELIS-CMSO), where he/she can enter his/her personal credit card, Visa or Mastercard details. To provide additional security for online payment by credit card, this payment will benefit from the 3D Sec program.

If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable.

The customer confirms that the credit card or PAYPAL account used is his/her property. WILDUST confirms (HTTPS certificate) that bank details will be processed securely.

The customer expressly recognizes that the communication of his bank card number to WILDUST is worth authorization of debit of his account up to the price of the ordered products.

The data recorded and stored by WILDUST constitute proof of the order of all sales made. The data recorded by PAYPAL or CITELIS constitute proof of any transaction between the customer and WILDUST.

- Secure payment by Paypal or credit card (via the PAYPAL system): the buyer selects the products he/she wishes to order in the "basket", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Payment by Paypal". In the next step, the buyer is asked to check all the information provided, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the PAYPAL secure interface, where he/she can enter his/her Paypal account details or personal credit card details. If the payment is accepted, the order is registered and the contract definitively formed. Payment by Paypal account or credit card via Paypal is irrevocable.

In the event of fraudulent use of a credit card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to be fraudulent, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges incurred by the transaction, the cardholder must contest the debit in writing to his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder's written objection. The cardholder will not be charged for the return of the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one's own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction.

A confirmation email summarizing the order will be sent to the customer immediately after the order has been placed. To this end, the customer formally accepts the use of electronic mail for confirmation by WILDUST of the contents of his order. Invoices will be available in the "my account" section of the site.

Article 5. Retention of title

The company WILDUST retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of the order to exercise his right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of return costs.

Only products purchased via the www.wildust.com website may be retracted. Any WILDUST brand product purchased in a retail store, on another website or in any other sales outlet cannot be returned or benefit from the legal withdrawal period. All product-related accessories, such as size and brand labels, must be enclosed.

Requests for returns from abroad are also at the customer's expense, with Wildust reserving the right to accept or refuse the parcel, in order to avoid having to pay import duties on its own merchandise.

Article 7. Delivery

Shipments are made on average between 24 and 72 hours after the order is placed.

For metropolitan France, the customer can choose between delivery to a Mondial Relay relay point, COLISSIMO (delivery service of the French Post Office with tracking, delivered without signature) or CHRONOPOST.

For French overseas departments and territories and countries outside France, delivery will only be made by Colissimo or Chronopost.

Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be cancelled and the purchaser reimbursed.

WILDUST may provide the purchaser with a parcel tracking number by e-mail.

The risks associated with transport are borne by the purchaser from the time the items leave the premises of the company WILDUST. WILDUST can not be held responsible for losses, delays in delivery due to errors or disruptions attributable to the Post Office. In case of damage during transport, any protest must be made to the carrier within three days of delivery. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person.

The information provided by the purchaser when placing an order is binding. In the event of an error in the customer's delivery address, or an incomplete address, WILDUST will not be held responsible for delays or non-delivery of the products ordered. In this case, the customer will be charged for the costs incurred for the reshipment of the products.

Any order delivered outside France may be subject to taxes and customs duties which will be imposed when the parcel reaches its destination. These customs duties and taxes are the responsibility of the customer.

In the event of force majeure, WILDUST will be released from its obligation to deliver; the following are considered as force majeure: war, riot, fire, flood, strikes, accidents, the impossibility of being supplied...

Article 8. Warranty

All products supplied by the company WILDUST benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to the company WILDUST who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by mail to the following address: SOCIETE WILDUST - 12C, Chemin de la devèse - 33360 - CARIGNAN DE BORDEAUX within thirty days of delivery.

8.1 Return policy

The customer must return his order within 14 days of communicating his decision to cancel. The product must be returned in its original packaging, new, unworn and unwashed. WILDUST specifies that it will only accept returns of products that are intact and unworn, otherwise the return guarantee cannot be claimed. All labels, care instructions and the original invoice must be attached to the product you wish to return.

The return of products is at the customer's expense and risk if the place of delivery is not in France.

Returns from abroad are not supported, nor covered in terms of costs or liability. Wildust cannot be held responsible for any costs related to a return from abroad, including customs clearance or VAT. Therefore, Wildust is able to refuse a return from abroad, if it requires the custom clearance back.

8.2 Refund of Products returned under the right of withdrawal.

Wildust will issue a refund within fourteen days of receipt of the returned goods.

Wildust will make a refund using the same means of payment that was used to pay for the order.

Article 9. Responsibility

The company WILDUST in the process of distance selling, is bound only by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, service interruption or other involuntary problems.

Article 10. Intellectual property rights

All elements of the www.wildust.com website are and remain the exclusive intellectual property of WILDUST. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site they are in the form of photo, logo, visual or text.

Article 11. Personal data

The company WILDUST undertakes to preserve the confidentiality of the information provided by the purchaser, which he would be brought to transmit for the use of certain services. Any information concerning the purchaser is subject to the provisions of law n° 78-17 of January 6, 1978. As such, Internet users have the right to access, modify and delete information concerning them. Article 12. Settlement of disputes

The present conditions of distance selling are governed by French law. Any dispute relating to the commercial relationship between WILDUST and the customer shall be subject to the jurisdiction of the French courts.
